SCHEDULE OF FEES
AND SERVICES

line

We Feel that Before Hiring Any Attorney, you should be able to have an estimate of the costs of his or her representation. You may be quoted a flat rate fee for the services, or an hourly rate. Most flat rate fees are based on the attorney's estimate of the time require to perform a particular service.
hourglass

Our Fees are based on an Hourly Rate:

On Civil Cases our charges are $185.00 Per Hour for Office Time and $225.00 Per Hour for Out of Office or Court Time. Charges are only for Actual Time Devoted to Matter.

On Criminal Cases our charges are $200.00 Per Hour for Office Time and $250.00 Per Hour for Out of Office or Court Time. Charges are only for Actual Time Devoted to Matter.

In addition to the Hourly Rate, Charges will be made for necessary expenses incurred. Such charges include: Court Costs; Issuance of Summons or Subpoenas; Service of Process; Postage; Copies of Pleadings & Documents; Long Distance Telephone Calls; Deposition and Reporter Expense; Expert Witnesses; Investigations; and Costs of Exhibits.

We provide an itemized accounting for all time and charges.

The Following Estimates of Total Charges are based on Normal Time and Expenses and will normally cover the entire charges for the Services Rendered.

The amounts shown for 'court costs' and 'filing fees' reflect the statutory costs in Oklahoma. These costs may vary in other states.

We strongly recommend that before you hire a mechanic, contractor, plumber, electrician or attorney you get a firm estimate of what his or her services are going to cost you!

Because of recent changes in the Bankruptcy Laws Our office has decided to no longer handle bankruptcy cases.

In our humble opinion the changes have placed undue hardship and expense on persons needing bankruptcy protection.

question - CONTINGENCY FEES:

The law prohibits an attorney representing a client on the basis of a Contingency Fee in Divorce Actions or Criminal Matters.

We do handle some types of cases on a contingency basis and the fee schedule will be discussed and agreed to in writing prior to either the client or attorney assuming any obligations to the other.

In the event of recovery the attorney would be paid a percentage of the total amount of recovery. In the event that there is no recovery the attorney does not get paid!

The percentage is generally based on the type of case, whether settlement might be likely, or whether a trial is a certainty. This contract percentage may be graduated. It will generally be lower in the event the case is settled prior to filing a lawsuit - then graduate in the event of certain contingencies such as filings of Motions for Summary Judgment, and trial.

The Rules of Professional Conduct require that a 'contingency fee' agreement be in writing, and state all the conditions of the employment of the attorney.

stop

Before engaging in any litigation you should be aware that in some instances the prevailing party may be entitled to attorney fees as part of the judgment.

In those cases, If you lose you may have to pay the attorney fees for the other party - in addition to your own.

However, in most instances each party must pay their own attorney fees - win, lose or draw!

You should discuss this with your attorney prior to getting involved in litigation.

paper - TRUSTS - Popularly known as 'Living Trusts'

These are generally revocable, and in some cases may be used to avoid probate. In order to be effective they must be periodically checked and property to be included in the trust must be identified - either in the trust, or titled property must be held in the name of the Trust.
  • Hourly Charge for Preparation - Approximately - $750.00 and up.
  • Plus Costs of Preparation of Documents of Transfer
  • Plus Costs of Recording Memorandum and Transfer Documents

stop - Caveat: - Many times this instrument is meant to be used to avoid probate, but sometimes valuable items, i.e., jewelry, stamp and coin collections, antiques, etc., are not properly transferred to the Trust, and a probate may be necessary to distribute those items.

VACATE DIVORCE DECREE AND COURT APPEARANCE: - $350.00

Kisses

Many times after a Divorce has been granted the parties may want to resume their marriage. This can be done by Vacating the Divorce, thereby restoring the Marriage as though the Divorce had never taken Place.
Vacating a Divorce Decree has many advantages over re-marriage, the most obvious of which is the preservation of the anniversary of the marriage. This is important for establishing certain spousal rights to Social Security and other benefits, which may be available only after a 20 year marriage.

Two Ten Year Marriages to the same person do not count as one 20 year marriage!.

Also - Vacating a Divorce Decree may restore property rights which had been divided in the Divorce. Property which was awarded in a Divorce Decree to one of the parties, is separate property when brought into a remarriage.
